Federal Judge George Wu on Feb. 10 rejected a declaration seeking a light sentence for medical marijuana provider Charles Lynch based purely on the document’s size.

Lynch, who was convicted of selling marijuana in a federal court last summer, may well serve at least five years because of federal mandatory minimum sentencing requirements. His attorneys filed more than 60 pages worth of arguments in a motion asking Wu to veer from the guidelines. The declaration details Lynch’s efforts to comply with state law, which allows qualified patients to use and distribute marijuana under certain circumstances. The judge said the motion was too voluminous.

The defense team can’t start again; the deadline has passed.

Lynch’s attorneys are asking for one year of probation instead of five or more years in prison. His sentencing hearing has been moved from Feb. 23 to March 23, but Lynch’s supporters are still planning a rally outside the federal courthouse in Los Angeles at noon on Feb. 23.
