Court overturns Prop. 8

A federal judge has overturned Proposition 8, the controversial California measure that made gay marriage illegal in 2008.

Judge Vaughn R. Walker, the chief judge of the U.S. District Court for the Northern District of California, released his decision on Aug. 4, ruling that Proposition 8 is unconstitutional for limiting marriage to only between a man and a woman.

“Proposition 8 was premised on the belief that same-sex couples simply are not as good as opposite-sex couples,” Walker wrote.

Proposition 8 opponents challenged the initiative, which was passed by a majority of Californians in November 2008. Both sides have indicated they’re willing to fight all the way to the U.S. Supreme Court.
