After a fast-paced court battle, Propostion 77, which would create a new way of drawing the state's legislative districts, will go before voters in the Nov. 8 election.

The California Supreme Court overturned a 3rd District Court of Appeal ruling that had removed the proposition from the ballot.

At issue was the language of the initiative. The measure's proponents had circulated petitions with different language than the draft they submitted to the attorney general. The proponents knew of the discrepancy in May, according to court documents, but didn't notify the secretary of state until mid-June, after he had certified the measure as having received enough signatures.

Such an oversight broke state rules, the appellate court said, and the measure would not have been on the ballot if the decision was left there.

The proposition seeks to take redistricting out of lawmakers' hands and allow a panel of judges to draw the districts' boundaries.
