Michael Tocher, of Nipomo, and the American Civil Liberties Union announced they will file a lawsuit against the Santa Barbara Police Department for violating Tocher's 1st and 4th Amendment rights.
On Veterans Day last year, Michael Tocher and his brother George went to State Street in Santa Barbara to read the then-1,200 names of soldiers killed in Iraq. Michael Tocher told New Times he used a bullhorn during the commemoration. Police stopped the two brothers and arrested Michael.
According to Elizabeth Brennan, spokesperson for the ACLU of Southern California, the city of Santa Barbara denied the claim for damages that the two brothers filed in May.
