Central Coast Compassionate Caregivers, the medical marijuana dispensary in Atascadero, will be able to stay open, for now. Compassionate Caregivers opened on January 9, but on January 24, the city ordered Charles Lynch, owner of the dispensary, to shut down the clinic and apply for a permit to operate the business. He complied with the order but quickly sought legal assistance.
Lynch has now obtained a temporary restraining order against the City of Atascadero, requiring the city to allow the dispensary to stay open through February 17. Then, the city will have to demonstrate cause for shutting down the clinic, explains Lou Koory, Lynch’s attorney. The City of Atascadero is the first city in the county to establish an application process and regulations for medical marijuana dispensaries.
The final goal, Koory says, is to receive a permanent injunction that would forbid the city from shutting down Compassionate Caregivers. “We’re not suing for big money, he says. “We’re not even suing for damages. We just want an injunction. ∆
