The Port San Luis Harbor District won a victory on June 28 when a civil jury decided that though the district was guilty of breach of contract, its tenants incurred no damages, said Steve Adamski, an attorney for the Harbor District.
Barry Cohen and his son, Leonard, owners of Hartford Pierâ€™s Old Port Inn and fish market, had sought $4 million in damages due to what they called mismanagement and breach of contract. The Cohens claimed that the district had failed to properly maintain the pier, provide adequate parking, and allow truck access. They filed their claim in October of 2004.
The district offered to settle numerous times during the past year, but could never come to a monetary agreement with the Cohens. Ultimately, the jury awarded $50,000 to Barry and nothing to Leonard.
â€œIt was a total vindication for our client,â€? Adamski said. â€œWe are tired, but elated. It was a long trial for everyone.â€?
