A neighborhood group angered over restricted access to a walking path is suing the Weyrich Development Company, which is owned by David Weyrich, the local developer who owns the Carlton Hotel in Atascadero.
Residents of the Rolling Hill Ranchos Development off of Crestmont Drive in San Luis Obispo say Weyrich has illegally blocked access to a walking path with a large metal fence. Weyrich owns vineyards next to the development. According to attorney Roy Ogden, who lives in the neighborhood and filed the suit on behalf of his neighbors, said repeated attempts to work with Weyrich outside of court have failed.
The Rolling Hills Ranchos Development was built in the early 1960s with easements for various paths that intersect and outline the development. The deeded easements give residents paths to ride horses, bike ride, and walk. According to Ogden, children regularly use the paths to get to Los Ranchos Elementary School.
According to the lawsuit, "[The] easement prohibits the erection of any structures, including fences, within the easement. [The Rolling Hills residents] are informed and believe, and on that basis allege, that Weyrich erected a metal tubular fence across the access easement where [it] meets Quetzel Road."
Ogden does not know why the fence was erected, and calls to David Weyrich's attorneys went unreturned as of press time....
